TERMS AND CONDITIONS OF CONTRACT

 

 

1. APPOINTMENT OF WILKSVISON VIDEOGRAPHY (HEREAFTER DEFINED AS THE "STUDIO")

 

1a)  Payment of the initial booking fee confirms the booking with the studio.

1b)  It is understood that the studio has the priority for the acquisition of video footage.  This condition is of the utmost importance to the natural flow, creativity, and

        sequence of the videography, without the distractions likely to occur.  It is the responsibility of your family and friends to assist in enforcing this policy.

 

2. PROVISION OF VIDEO SERVICES

 

2a)  Extreme professional care and diligence will be exercised by the studio in the provision of the video service, but no warranty is expressed or implied.

2b)  The shooting and editing of video footage shall be carried out at the artistic discretion of the studio which shall shoot and edit as far as possible in compliance with

        any special wishes of the clients, but no special requested footage or still image is guaranteed to be included.  In the event that the clients request re-editing of the

        video after the completed edited video has been produced, then such re-editing shall be charged to the clients at $75 per hour.  It is also agreed that color-

        saturation, contrast levels, and the quality of images in the clients final video shall be left to the studio's artistic integrity.  The clients accept that work shown on

        display is an example of the general style and quality of the studio's product but that each videographic situation shall produce different results.

2c)  The clients acknowledge that there are elements beyond the studio's control in providing video services.  These could include, but are not limited to, the following:

        faulty material, equipment failure, loss of master tapes, industrial disputes, civil disturbances, weather conditions, acts of God, and non-attendance in the event of an

        accident or illness occurring on or before the date services are scheduled to be provided.    

2d)  In the case of faulty material, equipment failure,  loss of master tapes, or non-attendance by the videographer due to illness, accident or any circumstance beyond

        the studio's control, the studio's sole liability shall be limited to a refund of any money pre-paid under this agreement, and shall nullify any further obligation of the

        clients or the studio.

2e)  The studio shall not be liable to the clients for any unintentional loss, damage, or injury caused by on-site equipment or personnel .

2f)   It is the responsibility of the clients to secure permission of the church, synagogue, or wedding facility to videotape the ceremony.  Booking fee (reservation) and second

        installment, full or partial, are non-refundable if facility officials prevent videotaping.

2g)  No outdoor filming will take place during any level of mist, rain, hail, sleet, or snow.  Booking fee (reservation) and second installment, full or partial, are non-refundable

        if your outdoor event has to be cancelled due to inclement weather.  Always have an indoor back-up plan.

 

3. POSTPONEMENT, CANCELLATION, AND BOOKING DETAIL

 

3a)  The clients agree to immediately advise the studio of any alterations in pertinent details including, but not limited to, postponement, cancellation, change of event location,

        changes in contracted services, or set-up alterations.

3b)  The client accepts the responsibility to contact the studio at least two weeks prior to the schedule date of service to confirm that all details are correct and that there are

         no alterations.

3c)  In the event of cancellation by the clients, the studio's sole liability shall be limited to a refund of any money pre-paid under this agreement (less the initial booking (reservation) fee)

        if cancellation is made at least 30 days prior to the event date, otherwise booking fee (reservation) and second installment are non-refundable. Cancellation by the client shall nullify any

        further obligation of the clients or the studio

3d)  In the event of postponement by the clients, all fees pre-paid may be re-applied, subject to availability.  In the event the studio is unavailable  to provide service for the rescheduled date,

        the studio's sole liability shall be limited to a refund of any money pre-paid under this agreement (less the initial booking (reservation) fee) if the postponement is made at least 30

        days prior to the original event date and shall nullify any further obligation of the clients or studio, otherwise booking (reservation) fee and second installment are non-refundable and shall

        nullify any further obligation of the clients or the studio.

 

4. TERMS OF PAYMENT

 

4a)  The initial booking (reservation) fee required is 25% of the contract total and is due and payable upon contract signing.

4b)  The clients agree to pay a second installment of  50% of the contract total and is due and payable at least 30 days prior to the scheduled date of service.  Failure of payment entitles the   

        studio to refuse to provide the contracted service(s), and the clients agree to forfeiture of the initial booking (reservation) fee.

4c)  The final contract balance, plus any balance for additional client contracted service(s) is due and payable 30 days after the event date, or 10 days before pick-up/delivery, whichever comes

        first.  A late fee of $20 per month will be added to all outstanding balances starting 31 days after the date of service.  Failure of payment entitles the studio to retain possession of videotape(s) and     

        DVD(s), and the clients agree to forfeiture of the initial booking  (reservation) fee and second installment amount and shall nullify any further obligation of the studio.

5. OWNERSHIP / COPYRIGHT

 

5a)  Federal copyright laws dictate that no video footage may not be copied or reproduced in any form without the written approval of the studio.  Copies made from the master tape may be requested

       at any time, and purchased at the currently published rate.

5b)  The studio retains ownership of and has the sole right to use any or all of the original video footage for advertising, publicity, exhibition, and any other purposes thought proper

        by the studio.  It is the clients responsibility to advise any or all participants and attendees that the event will be videotaped, and all parties will therefore be considered as

        consenting to be included in the video footage by their presence.

5c)  The client shall supply any non royalty free music they wish incorporated in their video production, and assume all liability for any copyright infringement.  To ensure the highest quality  

        in the final production, music must be supplied on Compact Disc or Mini Disc formats.

 

6. ADDITIONAL COVERAGE OPTIONS /  EXTENDED TRAVEL

 

6a)  Additional coverage options may be requested by clients before, during, or after the  day of event and is billed at the rate in effect at that time.

6b)  If mileage for event exceeds 100 total miles, a surcharge of $25 per hour will be assessed.

 

 

We have read and agree to the above terms and conditions and authorize WilksVision Videography to videotape our wedding per the above terms and conditions.
